Copyright takedown notices, counter-notices, and the removal process for nonconsensual intimate imagery.

Copyright Infringement Notices (DMCA)

Aebly Media respects the intellectual property rights of others and expects the people who use the Service to do the same. If you believe that material available on or through the Service infringes a copyright you own or control, you may submit a notification under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our Designated Agent:

What a valid notice must contain

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by one notice).
  3. Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (a URL, or a description of where it appears in the app).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We process valid notices within 48 hours. When material is removed or disabled, we make a reasonable effort to notify the user who provided it.

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.

Counter-Notices

If material you posted was removed and you believe the removal was a mistake or a misidentification, you may send our Designated Agent a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the United States District Court for the Southern District of California), and that you will accept service of process from the person who filed the original notice or their agent.

Unless the original claimant notifies us that they have filed a court action, removed material may be restored in ten to fourteen business days after we receive a valid counter-notice.

Repeat Infringers

Accounts of repeat infringers are terminated. We may also, at our discretion, limit access to the Service for any user who infringes the intellectual property rights of others, whether or not repeatedly.

Nonconsensual Intimate Imagery

Aebly Media prohibits intimate imagery published without the consent of the person depicted — including imagery that is AI-generated, edited, or otherwise manipulated to depict an identifiable person ("digital forgeries"). This process implements the federal TAKE IT DOWN Act, and it exists apart from copyright: you do not need to own any rights in the image to use it, and you do not need an account.

How to report

Email legal@aeblymedia.com with the subject line "Intimate Imagery Removal" and include:

  1. The URL(s) of the material, or a description of where it appears in the app, sufficient for us to locate it.
  2. A statement that the imagery depicts you (or the person you are authorized to represent) and was published without consent.
  3. Your contact information so we can confirm the outcome.
  4. A good-faith signature (typing your full name is sufficient).
